Terms of Service

Welcome to The Mixterverse, operated by ArtisTech Media, LLC (“ArtisTech,” “we,” “us,” or “our”). These Terms of Service, together with our Privacy Policy, form a binding agreement between you and ArtisTech governing your use of mixterverse.com and its related sites (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
These Terms are a contract between you and ArtisTech Media for using the Mixterverse. The plain-English notes are summaries, not part of the contract.
1. Changes to these Terms
We may change these Terms from time to time and will post the updated version with a revised date. If a change is material, we will make reasonable efforts to post a prominent notice. Continued use after changes take effect means you accept them.
These Terms can change; if you keep using the Service, you accept the changes.
2. The Service and your account
The Mixterverse is a music discovery and collaboration platform built around a shared library of Creative Commons and artist-licensed music, including an always-on radio and, for signed-in users, favorites and creator/partnership features. Some features require signing in with Google; you are responsible for activity on your account and for keeping your credentials secure, must provide accurate information, and must be at least 13 years old.
Use the Service responsibly — you’re responsible for your own account.
3. The music and licensing
The Service surfaces music from more than one library, and each track is governed by the license its creator chose:
- ccMixter tracks are offered under Creative Commons licenses — follow that track’s terms (for example, attribution and any non-commercial restriction).
- MixterPlus tracks use Group Copyright (each artist owns their own contribution) and may be remixed and shared under a Free License for Creators; use beyond the sites and social media may require an Extended Paid License.
The applicable license is shown with each track — check it before you use the music. We grant you no rights beyond what that license provides, and you are solely responsible for your use of any track, including providing proper attribution.
Every track has its own license (Creative Commons or MixterPlus). Check it and follow it before you use the music.
4. Content on the Service
Content available through the Service is provided “as is.” We do not warrant that it is accurate, non-infringing, or appropriate for your purpose, and you may encounter content you find objectionable. Review a track’s license before relying on it.
5. Your content
If you submit content (uploads, comments, images, and the like), you represent that you have the rights to do so and that it does not infringe anyone else’s rights. You grant us a non-exclusive license to host and display it as part of operating the Service; you retain your own rights in it. We may (but need not) review content and may remove it at our discretion. Keep track descriptions, reviews, and forum posts on-topic and lawful.
We don’t take ownership of what you post — but only post what you have the right to, and keep it appropriate.
6. Prohibited conduct
You agree not to:
- use the Service unlawfully or to infringe others’ rights;
- send spam or unsolicited promotional material;
- disrupt, overload, or damage the Service, or upload malware;
- post content that is harmful, harassing, hateful, or invasive of privacy, or share personal information about anyone under 13;
- impersonate others, or access accounts or systems without authorization.
Play nice, be yourself, and don’t break the law or disrupt the Service.
7. Third-party services
The Service uses third-party services, including Google Sign-In and YouTube API Services. Your use of those features is also subject to Google’s and YouTube’s terms and policies; see our Privacy Policy for the data involved.
8. No legal advice
ArtisTech is not a law firm and does not provide legal advice. Nothing on the Service creates an attorney-client relationship or should be relied on as legal advice.
9. Disclaimers
To the fullest extent permitted by law, the Service and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including title, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, ArtisTech Media, LLC will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for the content or conduct of third parties on the Service, arising from or related to your use of the Service.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless ArtisTech Media, LLC and its officers, directors, employees, and agents from any claims, losses, and costs (including reasonable attorneys’ fees) arising from your violation of these Terms, your use of the Service, or the content you make available.
12. Trademarks
The Mixterverse, ccMixter, MixterPlus, and related names and logos are marks of ArtisTech Media, LLC. You may refer to them to identify our services, but not in a way that implies endorsement or that you have rights to them.
13. Copyright complaints (DMCA)
We comply with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, contact our designated agent, Emily Richards, at info@artistechmedia.com or ArtisTech Media, LLC, 2118 Wilshire Blvd Ste 644, Santa Monica, CA 90403.
14. Termination
We may modify, suspend, or terminate the Service, or your access to it, at any time. You may stop using the Service at any time. Your right to use it ends automatically if you breach these Terms. The disclaimers, limitation of liability, governing-law, and indemnification provisions — and the license grants in your content — survive termination.
Either of us can end this, and some parts of these Terms keep applying afterward.
15. Governing law and miscellaneous
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules, and any dispute must be brought in the Central District of California, whose jurisdiction you consent to. A failure to enforce any provision is not a waiver; if any provision is held unenforceable, the rest remain in effect. No agency, partnership, or employment relationship is created by these Terms, which (together with the Privacy Policy) are the entire agreement between you and ArtisTech regarding the Service.
